In a split judgment, the Osun State Governorship Election Petition Tribunal sitting in Apo, on Friday, nullified the election of the Governor of Osun State, Gboyega Oyetola and ordered the Independent National Electoral Commission (INEC) to immediately withdraw the Certificate of Return earlier issued to him as winner of the September 2018 Election.
However, the chairman of the Tribunal, Justice Ibrahim Sirajo upheld Oyetola’s election.
In the majority judgment delivered by Justice Peter Obiara, the tribunal set aside the rerun election conducted on September 27, 2018 for being unlawful.
Justice Obiora held that the poll conducted in the seven units is unknown by law because INEC has no power to conduct it.
The tribunal declared candidate of the Peoples Democratic Party’s (PDP), Ademola Adeleke in the governorship election as the duly elected governor and ordered INEC to immediately issue him with Certificate of Return.
The tribunal agreed that PDP and Adeleke established beyond reasonable doubt that INEC did not comply substantially with the Electoral Act in 17 polling units.
Consequently, over 2,000 votes credited to the All Progressives Congress (APC) and Governor Oyetola by INEC were deducted from the tribunal, while over 1,000 votes said to have been scored by the PDP and its candidate were also removed from their total votes.
The majority judgment held that the returning officer who cancelled the result in the affected units after the announcement had no power to have done so.

Fuwape said the election was inconclusive because 3498 votes were cancelled as a result of ballot box snatching that occurred in some polling units during the election.
The affected polling units were Ife North, (one polling unit), Ife south, (two polling units), Orolu,( three polling units) and Osogbo, one polling unit.
According to Fuwape, Sen. Ademola Adeleke, the candidate of the Peoples Democratic Party (PDP) scored 254,698 votes, while Alhaji Gboyega Oyetola, the candidate of the All Progressives Congress (APC), scored 254, 345 votes. He thus called for rerun elections at the polling units where results were cancelled.
The majority judgment after deductions of the votes recorded in the rerun poll gave Adeleke’s score as 253777 and Oyetola’s as 253,476.
In the minority judgment, Justice Ibrahim Sirajo, Chairman of the tribunal, held that the petitioners, PDP and Adeleke failed to prove how the non-compliance of non-recording in the columns of accredited votes and account of ballots in the result sheets substantially affected the final results.
He further stated that even when non substantial compliance affects the outcome of the election, the tribunal, by virtue of section 140(2) of the Electoral Act, does not have the power to subtract the votes affected by the non-compliance from the scores of the candidates and announce a winner.
According to him the tribunal only has the power to nullify the results of the Polling units affected by the noncompliance and order a supplementary poll.
He concluded that even if the non-compliance was substantial, it was not proved by the petitioners
Earlier, in a ruling on an objection filed against the petition by APC, Oyetola and INEC, the tribunal held that the objection was misconceived and that the tribunal has jurisdiction to entertain the suit.
The objection was consequently dismissed by the tribunal.

Sergeant Damilola Adeoye attacked on Wednesday afternoon by hoodlums in Mile 12 Lagos had passed on, the police said Friday.

Adeoye was assaulted with cutlasses and broken bottles during a clash between officials of the Lagos State Taskforce and suspected cultists in Mile 12.

The victim who was rushed to the Lagos State University Teaching Hospital (LASUTH) where he was admitted at the Intensive Care Unit (ICU) died Friday morning.

It was gathered that he had sustained deep brain and neck injuries from the attack allegedly triggered by the shooting of a commercial bus driver.

Meanwhile, another Sergeant, Mudi Emmanuel fingered in the death of an SS1 pupil Adijat Shakiru at Adamo in Ikorodu will be charged to court for murder.

A statement by the police said Emmanuel was found wanting for professional misconduct and was undergoing orderly room trial at the command’s Provost Marshal Unit.

Spokesman for the command Bala Elkana, a Deputy Superintendent of Police (DSP) who signed the statement said Emmanuel’s actions fell short of the Rules of Engagement for the Use of Firearms and Professional Standards for Police Officers.

“He will be charged to court for murder. The command is determined to continually uphold the rule of law and protect the fundamental rights of the people.”

On the death of Sergeant Adeoye, Elkana said that the seven suspects earlier arrested will have murder added to the charges earlier drafted against them.

He said: “The Police Sergeant injured by miscreants at Mile 12 while carrying out his legal duties alongside other members of Lagos State Taskforce on Environmental Sanitation and Special offenses, Sgt Damilola Adeoye has died Friday morning in the hospital.

“The seven suspects arrested in respect of the attack will in addition to initial charges drafted against them, be charged for murder.”

The All Progressives Congress (APC) in Osun says it will appeal the tribunal judgment that declared Sen. Ademola Adeleke of the Peoples Democratic Party (PDP) winner of the September 2018 re-run governorship election.
Mr Kunle Oyatomi, the APC Director of Publicity, Research and Strategy, said in a statement on Friday in Osogbo that the verdict would not stand superior legal scrutiny.
” We are going to appeal the judgment. The verdict cannot stand superior legal scrutiny. Therefore we will appeal against it,’’ Oyatomi said.
The PDP in the state, however, commended the judiciary on what it called a landmark judgment.
Mr Soji Adagunodo, the Osun PDP Chairman, in his reaction, said the victory was for the people of the state.
Adagunodo said the judgment shows that “ we still have men of impeccable character in the judiciary.’’
” Kudos to the Nigerian judiciary and this shows that we still have men of impeccable character in the judiciary.
“Truly, the judiciary is the last hope of common man,’’ Adagunodo said.
Adagunodo said since the APC had decided to appeal the judgment, PDP would await the outcome at the appellate court.
The News Agency of Nigeria (NAN) reports that the Osun State Governorship Election Petition Tribunal sitting in Abuja on Friday declared Adeleke winner.
The three-member panel said during its ruling that the rerun election that held on Sept. 27, 2018, was illegal.
The tribunal, therefore, deducted the votes scored by the APC candidate, Gboyega Oyetola, in the rerun after declaring the rerun illegal.
The tribunal said Adeleke won the election at the first ballot on Sept. 22 and the rerun that INEC devised to reach a final conclusion a week later was illegal.
“The declaration of Oyetola is null and void,” the tribunal ruled in a majority decision with one member dissenting.

The Osun State Governorship Election Petition Tribunal sitting in Abuja has declared Ademola Adeleke as winner of the September 2018 election in the state and ordered the Independent National Electoral Commission to issue him with the certificate of return.
The three-man tribunal upheld the petitions filed by the candidate of the Peoples Democratic Party (PDP), Ademola Adeleke and the PDP, challenging the victory of the All Progressives Congress (APC) and Governor Gboyega Oyetola at the September 2018 governorship election.
PDP and Adeleke asked the tribunal to declare that he polled the highest lawful votes and should be declared the winner.
But Oyetola, APC and INEC had filed their notices of preliminary objection contending among others that the petition was incompetent and that the court lacked jurisdiction.
The tribunal also held that the supplementary election by INEC in seven cancelled units on Sept. 22,2018, was null and void.
The tribunal ruled that the Returning Officer who cancelled the results had no power to do so
The three-man tribunal had earlier dismissed the objections of the APC and Oyetola. It said Adeleke’s petition has merit. The tribunal also declared the rerun election as illegal.
Delivering the‎ ruling, Chairman Ibrahim Sirajo, held that the objections were misconceived and struck them out.
The Tribunal held that the CTC should and must be an exact replica of the EC8A pink copies.
The discrepancies must therefore be explained and justified by INEC.
In this instance, the tribunal held, INEC failed to explain nor justify the alterations and that they failed to call any witness to justify the alterations.
The tribunal held that the attempt to explain the alterations on the basis of mere corrections of errors is not acceptable and the fact that the said errors were consistently made in the disputed areas means it was a deliberate action taken.

A group of unidentified bandits attacked a mining site on Wednesday in Anka Local Government Area of Zamfara, killing one of the six mobile policemen on guard and abducting the others.

Speaking to journalists on phone, one of the eye witnesses to the attack, Salisu Lawali, said the bandits invaded the site situated in Sunke village after sporadic gun shots, disarmed the policemen, killing one of them in the process.

He explained that the gunmen abducted the policemen to an unknown destination and released the following day without their guns. Lawali said: “I don’t think there was any negotiation, because the abducted policemen just returned to the site unhurt, the only thing missing were their guns which they said were in the custody of their abductors,” he said.

Confirming the incident, the Chairman of Anka local government area, Alhaji Mustapha Gado, said the policemen were deployed to man the site. He said that the abductees were released after some hours.

“The Divisional Police officer of the local government told me that the officers were released but their rifles were still in the custody of the bandits. “We have earlier ordered for the closure of all the goldmines, but the foreign expatriates can still be found because their machineries are stationed at the sites. “We consulted the relevant authorities on the need to close down the sites and we got approval, we served them with quit notice but those operating the sites sourced for security operatives to man the sites for them,” he added.

Meanwhile, the Police Command in the state could not be reached for comments on the matter.
