Jonathan & Metuh

Embattled former National Publicity Secretary of the Peoples Democratic Party, PDP, Chief Olisa Metuh, has asked the Federal High Court in Abuja not to set aside the subpoena it issued to compel former President Goodluck Jonathan to appear as a witness in his ongoing trial.

Metuh further challenged Jonathan’s insistence that the defendant must deposit with the court, for and on behalf of himself, the sum of N1billion in line with provisions of Section 241(2) of the Administration of Criminal Justice Act, 2015, before he would mount the witness box.

Jonathan had in a motion his lawyer, Chief Mike Ozekhome, SAN, moved before the court on Wednesday, urged trial Justice Okon Abang to compel Metuh to pay the N1bn to cover travelling expenses for himself and his security personnel from his home town, Otuoke in Bayelsa State, to Abuja and also for time that he might spend appearing before the court as President of Nigeria between 2010 to 2015.

Jonathan maintained that the evidence Metuh is seeking from him would amount to an invasion of his personal right to privacy, and family life as provided for in Section 37 of the Constitution of the Federal Republic of Nigeria, 1999.

He told the court that the evidence sought to be obtained from him was likely to expose him to a criminal charge, penalty or forfeiture.

The former President further argued that the subpoena ad testifiandum Justice Abang issued against him on October 23 was vague, applied for and obtained on frivolous ground and in bad faith, saying it was meant to embarrass him as a person.

Besides, Jonathan argued that Metuh was not a personal aid or his appointee and therefore could not have dealt with the President directly under any circumstance to warrant the invitation of the applicant to testify in the charge.

He said there was no nexus between hiim and Metuh and the charge for which the defendants are standing trial.

However, the ex-President said he was not doubtful of the fact that there was a contractual agreement between Metuh and the former National Security Adviser, Col. Sambo Dasuki, retd. Ozehkome said: “The linchpin of this application is not that the former President is throwing doubts on transactions involving the defendants and Dasuki, but that he was not physically present when the transactions were going on, because he had many appointees.

“My lord, because of this, we are saying that he will not be a good witness to state what actually happened regarding the transactions.

“He can never be able to know details of transactions all his aides carried out within his over four years tenure in office. He is not saying that the transactions are fake or incorrect or fictitious, no! He is only saying that he does not know the details.

“Whatever evidence he will be giving based on the subpoena will amount to hearsay evidence”. Neverthless, in a five-paragraphed counter- affidavit that was moved by his lawyer, Mr. Emeka Etiaba, SAN, Metuh said he does not have N1bn to give Jonathan who he said had in his own motion admitted that he (Metuh) served the nation well.

Etiaba drew attention of the court to the fact that the bailiff earlier deposed an affidavit that he had yet to serve the subpoena on Jonathan. “This application is therefore not only soeculative but premature and deserves to be struck out.

“With respect to demand for deposition of N1bn, the 1st defendant in his affidavit averred that he does not have such amount.

“We believe that such demand is punitive and meant to frustate the 1st defendant’s attempt at obtaining an evidence that will assist him in the defence of the charge against him before this court.

“It is the view of the 1st defendant that from the first day that he was arrested, he made it clear that the release of the money was authorised by the former President and was released by the former NSA, Dasuki.

“My lord this application simply seeks to set aside the subpoena and to save this nation the embarrasment of having a man who means a lot to the entire country as a former President, to step into the dock to give evidence.

“My lord it is unprecedented, and the embarrassment could have been aborted if the charge against the 1st defendant was not preferred after he had disclosed to the EFCC the source of the fund for which the defendants are standing trial.

“My lord in the circumstance, it is our position that this application be struck out”, Etiaba added.

On its part, the EFCC, through its lawyer, Mr. Sylvanus Tahir, told the court that it would remain indifferent to Jonathan’s application.

Meantime, the court is still entertaining arguments from all the parties, including Dasuki who is asking Justice Abang to hands-off the trial for the Court of Appeal to decide the merit of appeal he lodged to void subpoena issued to also compel him to testify in the matter.

It will be recalled that Justice Abang had on October 25, handed the bailiff five days to serve the subpoena on Jonathan to enable him to appear as a witness in Metuh’s trial.

EFCC had in the seven-count charge it preferred against Metuh and his firm, Destra Investment Ltd, alleged that the defendants had before the 2015 presidential election, received N400million from the Office of the National Security Adviser, ONSA, without executing any contract.

It said the fund which was released to Metuh and his firm by the erstwhile NSA, Col. Sambo Dasuki, retd,‎ ‎was part of about $2.1billion earmarked for the purchase of arms to fight insurgency in the North East.

He was equally accused of money laundering. EFCC alleged that Metuh engaged in an illicit transaction that involved $2m.

The police in Lagos State are looking for friends of the two lovebirds found dead in a Toyota Corolla on Abisogun Leigh Street, Ogba, Lagos State.

The move, it was gathered, was to investigate what played out at a birthday party the duo attended the previous day.

LR News had reported that a tricycle rider and a member of the National Union of Road Transport Workers, had discovered that the lovers, identified as Lukmon and Promise, were motionless inside the car with its headlamps on.

They alerted operatives of the Area G Police Command, who opened the car door and found them dead.

While the man was reportedly met half naked on the driver’s seat with his private parts exposed, the woman was said to be in a gown, reclining on the passenger’s seat beside him.

A brand of alcoholic drink – Best –  and their phones were allegedly recovered from the car around 9am on Sunday.

It was gathered that Lukmon, Promise and some of their friends, had attended a birthday party at Obawole, in the Iju Ishaga area the previous evening.

A credible source at the Area G Command confided in our correspondent on Tuesday that the police were looking for the friends.

“For now, investigation is not pointing to a murder case. However, the investigation is still at a preliminary stage. We are looking for the friends they (the deceased) attended the birthday party with to get information on what transpired at the event,” the source said.

Another source said the case had been transferred to the State Criminal Investigation and Intelligence Department, Yaba, for discreet investigations.

The Lagos State Police Public Relations Officer, ASP Olarinde Famous-Cole, said the command would explore all the investigative angles to the incident.

He said, “It is still a case of sudden and unnatural death. We will leave no stone unturned. The families of the deceased will be interviewed. Investigation will be thorough to know if there was a foul play.

We have all been in that position where our laptop battery starts to malfunction; that moment when a 10-hour battery life device depreciates to serving you for one hour or less.

Insight from the Research and Development Unit of Yudala, shows that while laptop batteries often depreciate with constant use over time, misuse or wrong usage often leads to this happening within a short period of time and at a time when you should still be deriving optimum utility from your laptop battery.

Laptop batteries are made from lithium-ion batteries that have an average of 600 charge cycles and will work optimally for about four to five years without a drastic depreciation on battery life. Hence, your laptop battery should serve you well for at least three to four years depending on how frequently you use the device and recharge the battery.

Research shows that frequent travellers only get a couple of years out of their laptop battery because they tend to charge intermittently and keep their laptop unplugged when on the move which kills the laptop battery faster. To help you get maximum life out of your laptop battery, the following tips will go a long way in helping you save the cost of investing in a new battery at short intervals;

1.  Avoid soft surfaces: It is easy to place your laptop on your thighs or bed while working at home or during your rest time, however, if you need your battery to last long or have a stronger life span, it is advisable to place the device on hard surfaces such as tables or desks in order to avoid overheating.
Battery Longevity

Research has shown that heat is one of the biggest obstacles to your battery’s longevity because your laptop fan cannot circulate air properly when your laptop is placed on a soft surface.

2.  Practice proper battery storage: It is advisable to store your laptop in a cool place, this excludes cars during dry season. Laptop batteries do not work well with heat and might stop working if exposed to excessive humidity.

Research shows that, if a stored battery is not charged, it starts to lose it energy and might get damaged. Also, for travellers who leave their laptops behind, it is advisable to store your battery with a 40 – 60 percent charge instead of a full charge. Studies show that fully charged batteries depreciate faster than half-charged batteries.

3.  Avoid ‘battery empty’: A lot of us wait until our laptop dies before we plug it in, though mostly due to acute electricity shortage, it is not good for batteries. You should avoid letting your battery drain and discharge below 20 percent, else, it would reduce the charging capacity of your battery.

4.  Protect your battery: Make sure to take care of the battery contact points; the battery contact connects the battery to the laptop. If the contact point gets dirty or damaged, it may reduce or disrupt the flow of power to the laptop. If you have a removable battery, you can carefully wipe your battery with a soft cloth to get rid of dust. However, you have nothing to worry about if your laptop battery is sealed.

5.  Update your laptop: As underrated as this may sound, an outdated hardware may reduce the performance of your laptop thereby affecting the laptop battery.

The cells in laptop batteries degrade over time, and it is totally normal for old laptop batteries to hold charge less than an hour. Current laptops can achieve up to 10 hours of standard usage because of the software that comes with the perk of a new laptop. Henceforth, upgrading your laptop hardware will significantly improve your laptop battery life.

When a spender marries a saver, financial fireworks can ensue, and not the good kind. Should the duo combine accounts to minimise stress and create a new life together or keep separate accounts to maximise options and retain financial autonomy? Or, maybe try a mix of the two?

We spoke with financial counsellors, marriage therapists and individuals about each approach and received these tips:
Separate accounts: Neal Flesner, a 35-year-old management consultant in Los Angeles, maintains a separate account from his wife.
“I have my set of bills, and she has her set of bills,” he says. “It works.”

When the two tried a joint account, they found it challenging to track who had written the last cheque or how much money was left for separate ATM withdrawals.

With split accounts, they can access their own discretionary income and it has not created a complicated algebra of secretive purchases or stingy spending.

Flesner says he still checks in about expensive buys, such as a new bike, and often picks up restaurant tabs, as his income is greater.

When a recent electricity bill spiked due to heavy air-conditioning use, Flesner and his wife talked over how to deal with the problem and lower the monthly bill.

Couples who cooperate in this way earn financial and emotional rewards, says Tina Tessina, psychotherapist and author of ‘Money, sex and kids: Stop fighting about the three things that can ruin your marriage.’

“When a couple can talk openly about how they are handling their money, even if they keep certain accounts separate but have knowledge about them and access to them, it indicates that they are open about most things in their marriage, which predicts success,” she says.

Separate accounts earn additional relationship benefits when the couple sets up a joint account for paying mutual bills, says Tony Aguilar, founder of Austin, Texas-based Amiti Advising.

The joint account can be funded 50-50 or weighted according to income. But he recommends a joint credit card for entertainment and “fun” spending, so the miles and points can add up towards free airline tickets or a getaway.

Tessina says a hybrid setup of separate and joint accounts can minimise disagreements. “As long as no one is overdrawing an account or a credit card, and bill paying and savings are covered by the joint account, they don’t need to be concerned about who spends more on clothes or who (spends more) on meals out,” she says.

Joint accounts: Some people have a Jack-and-Jill bathroom and a bank account to match. Money from individual pay cheque is deposited into the account, and both partners can access the account, pay bills and save money.

Rebecca Desfosse, a New Jersey-based frugal-living blogger at DoggoneThrifty.com, shares a joint bank account with her husband, Ray. Joint accounts require mutual cooperation and provide mutual benefits, Desfosse says.

“You always have to be accountable to the other person,” which is beneficial, she emphasises. “It forces us to discuss every major purchase to determine if it is something we truly need and whether it is the best financial decision for our family.”

Desfosse and her husband stick to a predetermined budget. If one of them wants to buy something not included in that month’s budget, the couple discusses the purchase.

But joint accounts can create problems, if a spendthrift watches a partner splurge or if an earn-and-spend personality feels constantly criticised by a saver. They also can disagree on the items they want to buy. For example, she may like collecting vintage figurines while he wants to spend hundreds on a high-end barbecue. These differences can lead to resentment.

Any debates and spending styles are better dealt with directly, says Sharon O’Neill, author of ‘A short guide to a happy marriage.’ O’Neill strongly backs joint accounts.

“It is less complicated and forces you to discuss how you want to spend money,” she says. “You don’t have to agree on everything.” But with a joint account, there is no way to sweep financial disagreements under the rug.

To support some financial independence, O’Neill says each partner is allowed freedom to spend up to a certain amount. Over that amount, it becomes a point of discussion, pre-purchase.

 Accounting for openness
No matter which account approach is used, experts agree that openness and discussion are the keys to success. Tessina suggests weekly meetings for planning social events, conversing about financial goals and balancing the chequebook.

With the right attitude, this meeting can be a date. Combine it with a late-Sunday morning pancake breakfast or pair it with wine and cheese after the kids go to bed, Tessina says.

“As you talk about positive solutions and setting out long-term goals, many financial and other problems will be solved as they arise and before they become difficult,” she says.

Taking account differences to a professional also may be necessary. Like an iceberg in a relationship, the tip juts out in the form of “money troubles,” but beneath it a giant behemoth of power, security and family issues lurks. A professional financial planner or counsellor can help couples sort out the logistics of expenses, income, and checking and savings accounts.

With support, a couple can start down the right path together, establishing strategies of communication and motivation. “Much of finance is not necessarily about numbers but about habit,” Aguilar says. “If you establish the right habits early in life, everything else is going to work out for you.”

NACA DG, Dr. Sani Aliyu

The Director General, National Agency for the Control of AIDS, Dr. Sani Aliyu, says an estimated 200,000 people are living with HIV in Oyo State.

He said this on Tuesday in Ibadan during a courtesy call on Governor Abiola Ajimobi of Oyo State at the executive council chamber of the governor’s office.

The News Agency of Nigeria reports that the delegation led by Aliyu, included representatives of relevant international donor and funding agencies such as WHO.

Aliyu stated that only 16,000 out of the estimated 200, 000 persons living with HIV in the state were undergoing treatment.

“We have a gap between the number of infected persons and those on treatment. We have a gap between infected pregnant women and those receiving treatment.

“We also have issues with the number of new infections recorded,’’ he said.

The NACA boss stated that 10,000 pregnant women in Oyo State were living with HIV, adding that about 50 people contract HIV in the state on a daily basis.

He stated that the state had a considerable figure in terms of new infections, commending the state government for running one of the best programmes on HIV/AIDS.

Aliyu said that there were 1,060,000 people living with HIV in Nigeria, out of which only five per cent were currently on treatment courtesy of the Nigerian government.

Responding, Ajimobi assured the delegation of his administration’s readiness to partner them to bring the figure of infected people to a barest minimum if not totally eradicated.

Ajimobi, who was represented by his deputy, Chief Moses Adeyemo, said his administration would support the donor agencies with funds and human capital towards the eradication in the state.
