Security operatives on Tuesday nabbed three gunmen within the premises of a new generation bank in Amarata, a suburb of the Bayelsa State capital, Yenagoa.

The News Agency of Nigeria reports that the incident happened in the early hours of the day at the bank’s branch located in Amarata, in Yenagoa Local Government Area.

A source who preferred anonymity told NAN that one of the gunmen was sighted by the bank’s Manager via the Close Circuit Television in his office.

Suspecting that the young man must be up to something sinister, he immediately alerted the security agents at the bank, who swung into action immediately.

They took the suspect to a corner of the bank for interrogation which led to the discovery of a pistol in his pocket.

The suspect revealed upon further interrogation that there were two other members of his gang outside the bank premises, allegedly waiting to rob one of the bank’s customers.

The suspects were also immediately arrested, with one pistol each. They were handed over to the police.

When contacted, the Bayelsa Police Command Spokesperson, Mr Asinim Butswat, said he had yet to be briefed on the incident.

The National Chairman of the All Progressives Congress, Mr. Adams Oshiomhole, has urged the Federal High Court in Abuja to strike out a suit seeking an order compelling the Economic and Financial Crimes Commission to investigate allegations of corruption against him.

Justice Anwuli Chikere, on Tuesday, fixed November 19 for the hearing of the notice of preliminary objection filed by Oshiomhole, a former Governor of Edo State.

The plaintiff, Bishop Osadolor Ochei, had, on October 28, 2016, petitioned the EFCC asking the commission to investigate some corruption allegations against Oshiomhole as governor of Edo State.

Dissatisfied with EFCC’s alleged refusal to look into the case, Ochei filed the suit marked, FHC/ABJ/CS/628/2018 before the Federal High Court in Abuja, seeking an order of mandamus to compel the EFCC to arrest and commence criminal proceedings against Oshiomhole over alleged financial fraud while he was governor of Edo State.

The plaintiff attached to his suit 86 exhibits.

His lawyer, West Idahosa, had told the court that there were documents and electronic pictures of palatial houses credited to the former governor, whose earnings throughout his lifetime, according to the plaintiff, could not have been able to afford.

Idahosa added, among other allegations, that there was evidence of diversion of Edo State funds by Oshiomhole.

He said there were also vouchers of exorbitant air fares that the former governor allegedly incurred. But Oshiomhole, via a notice of preliminary objection filed before the court through his lawyer, Damien Dodo (SAN), contended that the plaintiff lacked the locus standi to institute the legal action.

He also specifically asked the court to strike out the plaintiff’s first prayer for being premature and incompetent.

In the notice of preliminary objection hinged on 10 grounds, the former governor contended that the applicant, having failed to file the suit for judicial review within three months of occurrence of the subject of the suit, the suit had become academic.

He added that the action or inaction of the EFCC being subjected to review by the proceedings occurred on December 13, 2016, while the plaintiff only instituted the action for judicial review on June 13, 2018.

He noted that this came about 18 months after the occurrence of the alleged failure being complained about.

Arguing that the plaintiff’s right of action had become unenforceable, Oshiomhole said the plaintiff had not disclosed that he had legal right to file and maintain the action for judicial review, “having not shown how the actions of the second respondent/applicant affected him over and above other residents and indigenes of Edo State.”

He further argued that the court lacked the jurisdiction to entertain the suit for failure of the plaintiff to commence the action within the time provided by extant rules of the court and for failure to disclose locus standi to file the action.

The presiding judge, Justice Chikere, had, on October 8, 2018, granted leave, as required by law, to the plaintiff to commence the suit of “judicial review”.

The judge had granted the leave following the ex parte application moved on behalf of the plaintiff by his lawyer, West Idahosa.

Granting the application, the judge ordered that Oshiomhole and the EFCC be served with all the processes filed in the suit.

She also ordered that the EFCC be served with the same court process, stressing that the service be done within five days from October 9, 2018 when the order was made.

Although EFCC was not represented by any lawyer during the Tuesday’s proceedings, the plaintiff’s lawyer, Idahosa, said the anti-graft commission was duly served.

Justice Chikere on Tuesday adjourned the matter till November 19 for hearing of the preliminary objection.

How, when and where do you meet each other and how do you woo her?

My first meeting with her was during the recruitment exercise at NPF Headquarters, Eleweran, Ogun State.
We keep friendship. I ask her out formally in November 2012 while in training at Police Training School (PTS), Iperu-Remo, Ogun State. The dating started in February 2013.




For how long do you court and what were your challenges?

We court for a year plus before going for our introduction in July 26, 2014.
Challenges are meant to happen but to the glory of God we overcome every challenges that comes our way.

Fresh facts have emerged on the promotion of three Deputy Inspectors-General of Police carried out by the Police Service Commission last week.

The commission explained that it rejected AIG Abdul Iyaji,  who was recommended by the Inspector-General of Police, Ibrahim Idris, for elevation to DIG.

The agency, in a statement in Abuja on Monday by its spokesman, Ikechukwu Ani, said it instead promoted Musa Mohammed as a DIG, being the most senior officer from the North-West.

The commission noted that the promotion was in line with its desire to sanitise the police and return the organisation to the path of rectitude.

Before the recent promotions, the commission explained that the Nigeria Police Force had four DIGs representing four geopolitical zones.

They are Maigari Dikko, from Katsina, representing the North-West; Joshak Habila, from Plateau State, representing the North-Central; Emmanuel Inyang, from Akwa Ibom State, representing South-South; and Agboola Oshodi-Glover, from Lagos, representing the South-West.

The PSC headed by a former IG, Alhaji Musiliu Smith, further said that since the new management assumed office, it insisted on working strictly with laid down rules and regulations guiding its constitutional mandate of appointment, promotion and discipline in the NPF.

The commission stated that this procedure was observed in the promotion of three AIGs to DIGs last week.

“The commission considered the recommendations of the IGP of three AIGs for promotion to DIGs: They were Mohammed Usman from Bauchi, representing North-East; Peace Ibekwe-Abdallah, from Anambra, representing the South-East and Abdul Iyaji from Kogi, representing the North-Central.

“At the time of the recommendation, Musa Mohammed was the most senior AIG in the Nigeria Police Force but was curiously not recommended.

“The commission in its wisdom and satisfying the necessary and relevant requirements approved the recommendations of Sani Usman to take the place of the North-East and Ibekwe-Abdallah for the South-East.

“It rejected the recommendation of Iyaji and in his place promoted the most senior AIG, Musa Mohammed from the North-West,” the commission explained.

Alhaji Ishaq Hadejia, Chieftain of All Progressives Peoples Congress (APC) in Jigawa has asked the minister of water resources, Alhaji Suleiman Adamu to resign his appointment as minister with immediate effect.

Hadejia stated this while speaking to the News Agency of Nigeria (NAN) in Dutse on Monday.

He alleged that Adamu has not been coming for political meetings or activities in the state because he said that he is not a politician.

“If that is the reason for the minister, he should better resign it is because of politics he was given the appointment. ”

“It is really unfortunate that if something happened in the state, whether good or bad, you will never see the minister coming to rejoice or sympathise with the people.”

“The recent flood which submerged over 500 communities in the state, with 40 deaths including lost of foodstuff, properties, farmlands, live stocks, the minister did not even bother to come and sypathise with the people”.

Hadejia stated that Jigawa said is an agrarian state full of potentials, as minister for water resources he didn’t care to collaborate with the ministry for agriculture to harness the potentials in it.

He said that Jigawa state government is currently spending billions of naira on water projects across the state but pointed out that the minister should say what is his contribution in that regard.

Stakeholders in health sector have urged the Federal Government to include Family Planning (FP) and other primary healthcare services provided by Community Pharmacists (CPs) and Patent and Proprietary Medicines Vendors (PPMVs), in information platforms.
The stakeholders made the call at the inaugural meeting for the development of PCN FP and other Primary Health Care (PHC) Strategic Plan in collaboration with the PSN-PACFaH@Scale in Abuja.
The stakeholders included the Federal Ministry of Health (FMoH), Pharmacists Council of Nigeria (PCN), National Agency for Food and Drug Administration and Control (NAFDAC) and Pharmaceutical Society of Nigeria (PSN)-Partnership for Advocacy in Child and Family Health @Scale Project (PACFaH@Scale.
Others are Community Pharmacists and PPMVs, Society for Family Health/IntegratE Project, among others.
They identified such platforms to include the National Health Management Information System (NHMIS) and the National Family Planning Dashboard, noting that community pharmacies and patent medicines shops were solution to achieving universal health coverage.
Giving an overview of the strategic plan, Dr Edwin Akpotor, Programme Manager, PSN-PACFaH@Scale said the plan would itemise what the council intended doing in repositioning CPs and PPMVs in providing extended services.
Akpotor said the three years strategic plan which would commence from 2019 to 2021 was meant for FP service delivery adding that for Nigeria to achieve Universal Health Coverage (UHC) there was need to include private sector healthcare provision.
According to the 2013 National Demographic and Health Survey (NDHS), 60 per cent of Nigerians patronise or obtain their services and other PHC services from private sector, which is the CPs and PPMVs.
He emphasised that with the current Task Shifting and Task Sharing (TSTS) policy of the government, more services would be given to CPs and PPMVs.
Akpotor said: “The Federal Government at the July 2017 London FP2020 Summit made a commitment to expand the FP services that community-based health practitioners such as CPs, PPMVs among others can provide.
“Through this commitment, the government believes the current FP unmet need can be bridged while increasing access to critical FP information and services especially in hard-to-reach environment and ultimately achieving the country’s modern Contraceptive Prevalence Rate goal (MCPR).
“In supporting the government to achieve this commitment and others, the PSN-PACFaH@Scale project is supporting PCN to develop a strategic plan (blue print) on re-positioning and strengthening the FP and other PHC services provided by CPs and PPMVs.
“Through the plan the council needs to have a plan on how to operationalise the TSTS, monitor, ensure supportive supervision of this group to provide accurate, exact services they are met to do,” he said.
Akpotor identified some of the task of the council to include demand creation and generation, creating awareness, ensuring that the practitioners provide the relevant information and services.
According to him, such measures will enable them to give right information to their clients or make a referral to the appropriate quarters when the need arise.
“When developed, the strategic plan will be leveraged upon by development partners and donors in strengthening the regulatory capacity of PCN and ensure CPs and PPMVs provide quality FP and other PHC information and services.

The Nigeria Security and Civil Defence Corps (NSCDC), Edo Command, has intercepted a truck laden with 45,000 litres of suspected illegally-refined petroleum products.
Mr Makinde Ayinla, the State Commandant of the NSCDC, made the disclosure to the News Agency of Nigeria (NAN) in Benin on Tuesday.
Ayinla said that the truck was intercepted at Aduwawa area on Benin/Auchi road.
He told NAN that the truck, which was laden with suspected illegally-refined diesel was loaded in Delta and heading to Abuja.
The NSCDC boss said the driver of the truck had been arrested and would soon be prosecuted.
Ayinla said that the command would continue to discharge its duties and ensure that the nation’s economic saboteurs desist from their unpatriotic trade.
The commandant advised petroleum marketers to shun acts inimical to the economic emancipation of the country and ensure that they got their products from the legal refineries.
He said this was imperative as any marketer that patronised illegal refinery would eventually suffer a loss as such products, if intercepted, would be destroyed.

Amid criticisms and call for slashing of its funds, the governor of Sokoto State, Aminu Tambuwal has called for more funding for the National Assembly to enable it perform its duties.
Tambuwal disclosed this on Monday while delivering a lecture at the Second Convocation and Awards Ceremony of the National Institute of Legislative and Democratic Studies (NILDS) in collaboration with the University of Benin.
The former Speaker of the House of Representatives said that even though it is an unpopular argument, that so long as Nigeria operates a presidential system of government, the funding of the National Assembly remained meager.
Giving insights on how to boost the institutional capacity of the National Assembly, the Sokoto Governor stressed that for the committees of NASS to work effectively, more money must be allocated.
“The constitutional responsibilities of the National Assembly are enormous, especially in the areas of law making and oversight. Adequate financial resources are required for the Assembly to be able to discharge these responsibilities effectively in line with public expectations.
“A study by NILDS observed funding gaps in critical areas of committee activities including meetings, implementation of oversight visits and activities, holding interactive sessions and conducting public and investigative.
“Am sure this may not go down well with a large percentage of the populace but we cannot run away from the fact that the National Assembly requires more funding,” he said.
He said that the issue of funding and procurement of vehicles was strongly argued when President Yar’Adua began the moneytisation policy and wanted to deprive the National Assembly of project vehicles.

The former lawmaker said that building the institutional capacity of the legislature was very key to the development of the nation stressing that strong institutions define a nation.
He however decried that a major challenge facing the legislature was that of high turnover, stressing that the way new lawmakers were elected into office does not give room for professionalism and expertise.
Tambuwal added that interference of the executive in the activities of the legislature must cease so that the legislature can truly be free to carry out its functions.
He called on NASS to legislate on budget cycle in a way that compels the executive to submit the budget on time while also advising them to review the recruitment process for legislative aids to ensure that only professional were employed and not friends or allies of the lawmakers.
“Legislators-constituency relations should emphasise constituency-wide benefits. NASS should also invest in outreach programmes and strengthen linkages with non-governmental organizations (NGOs) as they play key roles in civic education.
“Legislature must continue to cultivate public trust in the democratic system through high ethical standards. This underscores the need to strengthen the ethics and code of conduct regime at the National Assembly in order to develop a culture of high etiquette for legislators and to rebuild public trust in the political system,” he said.
The governor congratulated the students who had graduated from the various courses of the Institute.
In an address, Prof Peter Lewis of Johns Hopkins University, commended the 4thRepublic Legislature, particularly the 8thNational Assembly for being the most independent legislature in the history of Nigeria.
Lewis, Director of African Studies and a Professor of Advanced International Studies, at the University in Washington DC, USA said that the first and second legislatures were basically instruments of the Executive.
He said that the second legislature for instance had only one member sponsored bill unlike the 8th National Assembly were most of the over 200 bills that had been passed were sponsored by members of the legislature.

“The National Assembly in Nigeria’s Fourth Republic – now in its fifth session since the inauguration of democracy in 1999 – is unlike any previous parliamentary institution since independence.
“This is not because of the design of the assembly, which has roots in the British parliamentary tradition rather, it is the roles and functions of the NASS that are distinctive. It is the first independent legislature in Nigerian history.
“In the First and Second Republics, the legislature had little autonomy from the executive, the Assembly was largely a debating chamber and an instrument of the executive.
“Since 1999, both the Senate and the House of Representatives have asserted roles in legislation, oversight and representation. More than 2100 bills have been shepherded through the Assembly during the span of the Fourth Republic,” he said.
For the President of the Senate Dr Bukola Saraki, who is the Chairman Governing Council on NILDS, he said that the National Assembly will continue focus on policies that would advance the people.
He said that the legislature would continue to be effective stressing that “an effective legislature is essential to democracy, the rule of law, human rights, and economic and social development.
“The core legislative, oversight and representative functions of the legislature provide an essential contribution to the quality our democracy and governance as a whole.
“In the 8th Assembly, the legislature has played a greater role in policy formulation and has engaged more robustly with the Executive at the various stages of policy formulation,” he said.
Saraki who presented the certificates to all 78 graduates of the various programmes of NILDS commended the graduands and the institution for the milestones recorded.
The News Agency of Nigeria (NAN) reports that the post graduate courses for which the convocation was held were Masters in Legislative Studies and Masters in Legislative Drafting.

Governor Ibikunle Amosun of Ogun is still sulking over the decision of the National Working Committee of the All Progressives Congress to uphold the candidacy of Dapo Abiodun as the governorship candidate for the state.
On Monday, he poured his frustration on Asiwaju Bola Ahmed Tinubu, Aremo Segun Osoba and party chairman Adams Oshiomhole, accusing them of conspiracy in dumping his preferred candidate, Abdulkabir Adekunle Akinlade.
At the ceremony to swear in Mojisola Dipeolu as  the new chief judge of the state, Amosun went ballistic and attacked the trio for  “conniving with a cabal in Lagos” to write a fake result which produced Dapo Abiodun as the party’s candidate for the 2019 governorship election.
In a report by Punch, Amosun  alleged that the silence of Tinubu and Osoba, who were aware of what transpired in the state with respect to the primary, smacked of complicity.
“The President already knows there was no election in Ogun State. He knows that they just went to Lagos; wrote all results, and that what they did was fraud.
“If the National Working Committee or the national chairman said there was any election in Ogun State, it was all fraud. That is what I said.”
“The issue of Chief Osoba and Asiwaju and co, what we said was that there was a definite silence from their end, and silence means consent. You can record me and publish it in your newspapers.
“We have not heard one word from any of them. Was there any election in Ogun State? ‘Yes’ or ‘No?’ They should come out and those that are hiding behind one finger, they cannot come out?”
“People at this level should be courageous enough to take position, to come out, to come and tell us whether there was election.
“On governorship, the day they said they did it or not, the one that we had, there was live telecast, people even witnessed it. They all came that they are changing again.
“They removed Leke Adewolu, Mikail Kazeem. All of those ones are nothing but fraud.”
As he spoke,  about 200 APC councillors in the state staged a protest at the Arcade Ground at the secretariat, demanding that the party’s NWC should recognise Adekunle Akinlade as the party’s governorship candidate.
The councillors marched with placards with inscriptions such as, ‘We want justice in Ogun APC’, ‘Give us Triple A’, ‘Oshiomhole, Osinbajo, we want justice in Ogun State’ and a ‘Minority cannot take charge over majority’, among others.
Almost about the same time, some groups namely, Ogun Progressive Students, Ogun Youth Assembly, Coalition of Ogun Traders, among others, organised a counter-protest not far away.
The protesters who converged on the Nigeria Union of Journalists secretariat, Oke Ilewo, urged Amosun, to accept the party’s decision and support Dapo Abiodun as the party’s the governorship candidate.
The groups on their part condemned what they termed the “determined mission of Amosun” to drag the hard-earned integrity of Ogun State through the mud.
They were led by the convener of Ogun Progressive Youths and students, Adeyemi Azeez; convener of Movement for Secure Nigeria, Abdul-Kabiru Ayoola; and the Secretary, Ogun Arewa Council, Idris Muhammad.
They also carried placards with different inscriptions, some of them read, ‘Adams Oshiomhole don’t compromise,’ ‘Protect our mandate,’ ‘Don’t compromise, Dapo Abiodun is our man,’ ‘Don’t kill democracy, the voice of the people must be heard, Amosun beware!’.

The Department of State Services (DSS), has denied that five of its personnel aided Nnamdi Kanu, leader of the Indigenous People of Biafra (IPOB) to escape from his Umuahia home on Sept. 14, 2017.
The News Agency of Nigeria (NAN) reports that Kanu’s whereabouts was unknown, until he surfaced in Israel recently, after the alleged Sept. 14 raid by a combined team of the Army, Police and the DSS at his home in Umuahia, Abia.
A statement by the Public Relations Officer of the service, Mr Peter Afunanya, said that the purported report was fake, mischievous and defamatory.
“The Service wishes to state that the news is fake, mischievous and defamatory. It is nothing but a figment of the imagination of the originators,” the statement quoted Afunanya as saying.
He said that the stock in trade of Kanu and his collaborators, was to peddle  rumours, gossips and propaganda aimed at subverting the government, its key agencies and officials,
He said that the service was aware of some unscrupulous elements keen on exploiting the situation to constitute a nuisance to the freedom of Nigerians as guaranteed in the Constitution.
Afunanya said that the elements were also keen on disrupting the forthcoming 2019 general elections.

A Federal High Court sitting in Abuja has ordered the Nigerian Police Force, Inspector Genersl of Police and the FCT Commissioner of Police to pay N50 million to Charles Oputa, a.k.a Charly Boy, the leader of ‘OurMumuDonDo’ movement.

The News Agency of Nigeria (NAN) reports that Justice John Tsoho awarded the amount on Monday while delivering judgment in a fundamental rights suit brought against the Police by Charly Boy.

Tsoho said the sum was a compensation for the violation of Oputa’s rights to dignity of the human person, freedom of expression, peaceful assembly and association.

He ordered the Police to publish an apology to Charly Boy in two national newspapers.

NAN recalls that in a suit filed on March 29, Charly Boy had accused the police and their officers of harassing him and members of the OurMumuDonDo campaign during the #ResumeOrResign protests.

Charly Boy through his lawyer, Mr Inibehe Effiong, argued that the Police attacked the group during a peaceful demonstration at the Unity Fountain in Abuja.

He asked the court to determine whether the “use of water cannons, teargas canisters and wild police dogs to harass him and members of his group during the said a peaceful protest on Aug. 8, 2017 is constitutional.
”
He argued that the act was an infringement on his fundamental rights, freedom of expression, peaceful assembly and association as enshrined in Sections 34, 39, and 40 of the Constitution of the Federal Republic of Nigeria, 1999 (as amended.

Charly Boy, therefore, prayed the court to make a compelling order on the FCT police and their commissioner to publish a public apology to him in five national newspapers.

He also demanded that payment of the sum of N100 million as general damages be awarded to the applicant as well as direct that N400 million be paid as exemplary damages by the police.

Delivering judgment on the case, Justice Tsoho held that there was no evidence that miscreants invaded or stormed the premises of the protest as alleged by the police.

On whether the Applicant is entitled to stage the protest, the court held that protest is a constitutionally-guaranteed right provided it is done peacefully.

“The Respondents (the Police) need not exercise an uncommon aggression and mayhem to ward off alleged miscreants.
“The law is that the court has the right to grant redress to anyone whose right is violated and the applicant is entitled to a remedy.

“Relief four is granted and the respondents are ordered to publish an apology to the applicant in two national newspapers for violating his fundamental rights.

“The sum of N50 million is awarded against the respondents as general and exemplary damages,’’ Tsoho ruled.

Reacting to the judgment, Charly Boy’s counsel, Effiong described it as “a resounding victory for democracy, freedom of expression and peaceful assembly in the country”.

“This judgment sends unequivocal message to the Nigerian Police that they have no power to stop or disrupt peaceful protests by Nigerians.

“The police by this judgment cannot invent flimsy excuses to stop citizens from exercising their fundamental rights to freedom of expression and peaceful assembly.
“I am highly elated by this victory for democracy,’’ he said.
